Discovery: The Exchange of Valuable Information in Your Personal Injury Case
Now that your lawsuit has been filed, it is time to participate in what is referred to as DISCOVERY. Discovery is the phase in litigation where we exchange information with other side so that both sides become more familiar with various parts of the case. It is basically a period of time where the lawyers for both sides use certain methods available to them under the Texas Rules of Civil Procedure to learn as much as we can about the case.
How does my Personal Injury Lawyer Get Information from the Other side?
Discovery can consist of Interrogatories, Request for Production, Request for Admissions and Request for Disclosures and depositions. Interrogatories are simply written questions that the other side asks for you to answer and are related to the case. Request for Production are requests for documents that we may have like medical or billing records, wage documents, etc. Request for Admissions are requests to admit or deny a statement. Finally, a Request for Disclosure includes items that we must respond to by rule.
Your Personal Injury Deposition
Once we have completed the discovery phase of your case, you can expect that the lawyer for the other side is going to request some dates where we can meet and he can interview you (deposition) about your work injury, the treatment you’ve had and, what you are claiming in your case. Don’t worry, as your personal injury, we will prepare you very well for the deposition. As your injury lawyer, we also get the opportunity to depose or interview the responsible parties in your case.
