As the employee was walking down the ladder, the unsecured cart suddenly moved. The unexpected shift caused her to fall three to four feet through the air, landing violently on the floor directly on her back. Shockingly, the company later failed to preserve this defective cart, destroying crucial evidence of their negligence.
Spinal Compression Fractures and Premature Clearance

Following the fall, the worker sought treatment and was diagnosed with an acute wedge compression fracture at the L1 vertebra and a fracture at the S5 segment. Despite the severity of her broken back, the employer’s work injury plan simply allowed the fracture to temporarily heal and prematurely released her back to full-duty work while she was still in pain.
Tragically, her injuries were far worse than the company doctors admitted. Forced to seek independent medical evaluation, new imaging revealed that the compression fracture was narrowing her thecal sac. To manage her debilitating pain, she had to undergo three epidural injections before ultimately requiring a right lumbar laminectomy and decompression microdiscectomy at L5-S1.

The aftermath of this incident has been devastating, both physically and financially.
Because the employer’s injury plan failed to provide adequate relief, the worker rapidly amassed over $234,445 in independent medical bills, requiring care from orthopedic surgeons, physical therapists, and pain management specialists. She later required additional medial branch block procedures to treat cervical radiculopathy caused by her continued trauma.
The severe fall continues to cause her intense pain and has drastically limited her ability to lead a productive work and private life.
